<p>Under Florida law, when a child is subject to a Florida Court’s “child custody” jurisdiction (either because of a dissolution of marriage case or because of a paternity case), the child’s parents are not allowed to move their residence more than 50 miles unless they obtain either (1) written consent of the other parent, or (2) court authorization to relocate. Such a relocation is governed by Fla. Stat. § 61.13001.</p>



<p>Recently, The Bonderud Law Firm was hired to represent a mother who sought to relocate more than 50 miles to another Florida city. The father of mother’s children objected to the relocation and, therefore, the Court convened a non-jury trial, which spanned two full days. After marshaling the mother’s evidence and presenting the testimony of numerous witnesses, in addition to cross examining the father’s witnesses, the Court sided with our client and authorized the relocation after finding that it was in the children’s best interests.</p>

<p>The Bonderud Law Firm recently completed a 2-day non-jury trial in a family law case, where our client had been accused of refusing to co-parent and attempting to alienate the other parent from the parties’ teenage child. After hearing taking testimony of both parties and accepting dozens of exhibits into evidence, the Court sided with Bonderud’s client, refused to modify the parties’ parenting plan, and refused to hold our client in contempt.</p>

<p>The Bonderud Law Firm recently earned an acquittal for a client who was charged with driving under the influence of alcohol. The client had just left a restaurant, where he had eaten dinner and had a single beer. While he was driving, he engaged in distracted driving after his children called his cell phone. A Jacksonville Sheriff’s Officer’s dash camera recorded our our client swerving out of and into his lane over a 60-second period, which gave the officer probable cause to initiate a traffic stop. Our client agreed to perform field sobriety exercises, but our client did not provide a breath sample. At trial, we scrutinized the evidence and challenged the assumptions that laid at the heart of the State’s case against our client. After less than an hour of deliberations, the jury returned a unanimous verdict: NOT GUILTY. </p>

<p>The Bonderud Law Firm recently completed a four-week jury trial that culminated with the firm’s client being acquitted of one of the largest federal health care fraud conspiracies ever alleged by the US Department of Justice. With federal prosecutors who flew in from Washington, D.C.’s DOJ Fraud Section at “Main Justice”, the Government called dozens of witnesses, including medical experts and cooperating Defendants, as well as introduced hundreds of exhibits. The Firm’s client was alleged to have participated in a scheme to defraud health insurance companies in connection with a complicated toxicology lab billing scheme that involved rural hospitals around the country. With skill and attention-to-detail, the Firm dismantled the Government’s case and established reasonable doubt. After four weeks of trial, the firm’s client was found not guilty. The client has begun rebuilding his life and is enjoying time with his family — all because of the results our Firm was able to deliver for him.</p>
